Warranty
A word with many meanings.
When used in connection with precontractual statements, a warranty is compared to a representation and means the more commercially important statement, which has contractual force and, if untrue, gives a right to the contractual level of damages.
When used in connection with provisions of the contract, a warranty is compared to a condition and means the less commercially important provision, which gives rise only to damages if breached, as opposed to a breach of condition which gives the right to terminate the contract.
