Judgement currency indemnity
An indemnity sometimes included in credit facilities to protect the lenders against losses they may suffer if judgement is obtained against the borrower in a currency different to that in which the facility is denominated.
Such an indemnity may not be enforceable in all circumstances and this is an issue for due diligence.
